Postal of Cadastral Survey in Lykovrysi, Metamorfosi, Nea Filadelfeia, Nea Chalkidona, Papagou, Pefki and Psychiko of the Attica Region

NCMA SA has made the following announcement:

On Monday 5 September 2016, the posting of cadastral data starts in the pre-Kapodistrias Municipalities of: Lykovrysi, Metamorfosi, Papagou, Pefki and Psychiko of the Regional Unit of North Sector of Athens and Nea Filadelfeia and Nea Chalkidona of the Regional Unit of Central Sector of Athens in the Region of Attica

Anyone with a legitimate interest may make an application to correct or appeal against posted data at the competent Cadastral Survey Office within two (2) months of the above date.

For expatriates and the Greek State the deadline is four (4) months.

To better serve rightholders, excerpts from the Cadastral Tables and Charts have been sent to them by post to the contact address declared by each citizen.

Through Posting, owners of real property are able to check that their ownership is registered and correct any errors. This process ensures that the cadastral survey will be completed properly and there will be no problems in the subsequent operation of the Cadastre. Therefore, at this stage the participation of citizens is essential in order to avoid unnecessary trouble in the future.

After completion of Posting, including the submission and examination of correction requests / complaints and the corresponding correction in cadastral tables, the final cadastral data and the Initial Registrations of the Cadastre are produced, and the Cadastral Survey Office starts to operate in this area instead of the Land Registry Office.

Electronic Posting of cadastral survey

 

When posting begins, rightholders will also be able to see data relating to them electronically through the Cadastre website www.ktimatologio.gr at the e-KTIMATOLOGIO Online Services portal.

The rightholders can see the details of Posting either by using the security codes of taxisnet applications or after creating (if this has not already been done) their personal Cadastre code and entering the "three keys" included in the declaration receipt. If taxisnet codes are used, they will see all properties of the regions, which are posted and linked with their TIN.

The online submission of the request for the correction of Personal data is also supported through the special "Posting application" at the Cadastresection of Online Services. The three keysto access this service are Declaration Registration Number, Personal Code Number and Property Code Number, which are recorded on the Submission of Declaration receipt.

Information Note on the Posting process

The Posting data are:

a) The Cadastral Table, which is organized by the Cadastral Code Number and   includes all the rights of the region, as documented by the titles and other information gathered during the cadastral process,

b) The Cadastral Chart (map of the Cadastre), which illustrates the properties along with their location and borders (geometrical data).

 

What you will receive and have to check

Each rightholder has received / will receive by mail to the stated contact address an envelope with excerpts of the Cadastral Table and Cadastral Chart (map) for the properties declared. 

 

The most critical point of the process is the careful check of the documents. If the rightholder agrees with these data, no further actions are needed. In case he does not agree with some of the registered data, he can apply for the correction/plea.

 

  • If someone submitted a property declaration but has not received the envelope, he should address to the Cadastral Survey Office.

 

The rightholder will receive the following forms:

FORM A: Rightholder`s Data - Property Code Number. The form includes:

  • Rightholder`s personal data
  • Property Code Numbers of the rights, for which a declaration has been submitted. These code numbers appear on the "Submission of Declaration receipt", received after the submission of the declaration.

FORM A1: Excerpt of the Posting Table. The form includes information concerning the legal status of the property:

  • Declared rights (number, type and percentage of the rights)
  • Title data
  • Property data (i.e. address, floor etc)
  • Joint rightholders (if any)

FORM A2: Excerpt of the Posting Chart. The form includes the  the information concerning the location and geometry of the property:

  • location, shape and size of the property
  • Details of neighboring owners (neighbors)
  • Coordinates of the property boundaries, especially if there are no delineated boundaries (fences, ditches etc) and all buildings or neighboring properties look alike.

Special cases

  • In the properties were declared but their identification was not possible, or the information provided is not considered sufficient, the rightholders will receive only the Form A.   
  • Also, some rightholders may see the data of their rights, for which they have not submitted a declaration, but they resulted from the processing of other data collected. For these rights, if someone continues to be a rightholder, a property declaration must be submitted and a fixed charge must be paid (35 or 20 euro).

In these cases, the rightholders will have to come to the Cadastral Survey Office in order to receive instructions for their actions.

 

Deadlines for submission of correction requests and appeals

The rightholders who disagree with some of the Posting data, as well as anyone with legitimate interest, can submit a correction request/ appeal within two months from the date of posting (and within four months for expatriates) to the competent Cadastral Survey Office.

The correction requests and appeals shall be submitted in person or on the basis of the authorisation granted and the prerequisite for their submission is a previously submitted property declaration and the payment of the fixed fee for property registration. The cost of submission of the correction request/appeal is 5€.

The correction requests are examined by the Cadastral Survey Office and the appeals are examined by a three-member committee which is chaired by a magistrate or a lawyer.

After examining all the submitted correction requests and appeals, a correction of cadastral tables and charts is carried out and the final cadastral data and the Cadastral Initial Registrations are produced.

What changes in the property Declaration process after the Posting

After the Posting starts, it is necessary to attach a Certificate of Cadastral Property to each transaction relating to the properties in the area. The certificate is issued by the Cadastral Survey Office and notaries must ask for it when drafting contracts. It is also mandatory during any hearing before the court, which relates to the property and during the registration of any registrable act in the books of Transfers and Mortgages of the Land Registry Office.
