The Cadastral Survey is in Progress...
Today the cadastral survey is continued with the processing of declarations and the exact demarcation of land parcels. The second phase will end with the formation of the interim cadastral tables within 2010. The tables will be suspended at the Cadastral Offices and the Municipalities, while at the same time, extracts from the cadastral registrations will be sent by post to those who have declared a right. The Suspension procedure will allow citizens to check the content of registrations and to submit objections to any errors or oversights. In the time period until the Suspension begins it is possible that you may need to address the Cadastral Survey Offices for a series of issues, like overdue declarations, declarations on new rights which were acquired after the declarations’ submission procedure expired, application for the correction of data contained in already submitted declarations and other pending issues. Until the suspension of cadastral data, for affairs like these you have to address the competent Cadastral Offices and following simple procedures, depending on the case, to settle them.

If you did not submit an ownership declaration to the Hellenic Cadastre in due time (until November 21st, 2008), you can submit an overdue declaration during the cadastral survey until the date that will be defined with a decision issued by the Hellenic Mapping and Cadastral Organization (HEMCO). However, a fine is prescribed in this case depending on the type and value of the properties. It is noted that the procedure according to which the fine is decided and afterwards imposed will be activated at a later stage. Consequently, at this stage you do not pay a fine, but only the fixed fee following the familiar procedure at the co-operating banks. If you wish to submit an overdue declaration you should use Form D1. The ownership declaration to the Cadastre is mandatory by the law and constitutes a prerequisite for any action that involves the property in the future (e.g. transfer, parental benefit or donation). Specifically, if no declaration has been submitted for a property in an area under cadastral survey, then either the initial owner should first declare it and afterwards transfer it or the property should be transferred and afterwards declared by the new owner. You should be informed that a building permit cannot be issued for properties which have not been declared.

Transfers during the Cadastral Survey
After the deadline for the submission of declarations expires and up until one month prior to the beginning of the suspension of cadastral data, any person or legal entity that acquires a right on a property (e.g. by inheritance) must submit a declaration to the cadastre. This declaration is not an overdue one, but it is laid down by the law in order to maintain the cadastral database updated during the transitional stage of the cadastral survey. In this case Form D2 is completed and the declaration is submitted to the competent Cadastral Survey Office within one month from the date when the right in question was acquired, meaning from the date when it was transcribed to the Land Registry Office.
It is noted that within the time period up to the suspension of the temporary cadastral data, notaries draw contracts according to the standard procedure without attaching to them any certificate or attestation that a declaration has been submitted. The same stands for Land Registrars who transcribe contracts without checking if the seller has submitted a declaration. The notary ought to remind that submitting a cadastre declaration is compulsory. A certificate attesting that a declaration has been submitted is needed for any contracts or judicial actions involving your property after the suspension.

Corrections after the Submission of a Declaration - Application Forms
1. Correction of the declaration detailsIf you wish to correct details in your declaration you can either submit in person to the competent Cadastral Survey Office or send with a registered letter an Application for Correction of Declaration Details, to which you will attach a declaration form having completed only the fields that need correction. 2. Correction of contact details In case the contact details you declared have changed you should notify the competent Cadastral Survey Office about it by submitting an Application for Notification of Contact Details Change. You will receive all relevant correspondence during the cadastral survey, e.g. cadastral data extracts, at the contact address you have declared, while contact telephone numbers will be needed in case clarifications are required. 3. Pendency in the declaration dossier or Contract Not Transcribed to the Land Registry Office If you submitted an ownership declaration to the Hellenic Cadastre for a property that you had not transcribed to the Land Registry Office, once the transcription procedure is completed, you can submit an Application for Lodgement of Supplementary Data to the competent Cadastral Survey Office, attaching to it the Transcription Certificate. It is noted that the transcription of contracts to the Land Registry Office is compulsory, meaning that the contract alone without its transcription does not lead to the acquisition of the right that is described in it.
